Terms of Service.
These Terms govern your use of the websites and online services operated by Koda Sampler, Inc. ("Koda", "we", "us") at kodasampler.com and its subdomains, including the KODA store and customer portal (together, the "Services"). By using the Services, you agree to these Terms.
Use of the KODA software itself is governed by the End User License Agreement (EULA), and our handling of your data is described in the Privacy Policy. If these Terms conflict with the EULA regarding the software, the EULA controls.

01 · Early Access
Early Access
KODA is currently in Early Access. The Services, the store catalog, pricing, and features may change, and availability is not guaranteed. See the EULA for what Early Access means for the software.
02 · Accounts
Accounts
You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for activity under your account. Don't share accounts or license keys. We may suspend or terminate accounts that violate these Terms.
03 · Purchases
Purchases, licenses, and trials
- Purchases of KODA software and sound libraries grant you a license as described in the EULA (or, for third-party vendor libraries, in the terms shown at purchase). You are buying a license, not the underlying intellectual property.
- Prices are shown at checkout and may change. Applicable taxes may be added based on your location. Payments are processed by Stripe.
- License keys are delivered to your account and/or the email you provide. Keep them confidential.
- Trial licenses are time-limited, for evaluation only, and may be modified or withdrawn.
- Refunds: All sales are final once the associated license has been activated, unless product-specific terms presented at purchase state otherwise. Nothing in this policy limits your rights under mandatory local consumer law, including the EU right of withdrawal and the Australian Consumer Law.
04 · Acceptable use

You agree not to: (a) interfere with or disrupt the Services; (b) attempt to access accounts, systems, or data you are not authorized to access; (c) circumvent license management, purchase, or content-protection mechanisms; (d) scrape or bulk-download content; (e) upload malicious code; or (f) use the Services to violate any law or third-party right.
05 · Vendor content
Third-party vendor content
The KODA store may include libraries and content from third-party vendors. Vendors are responsible for their content and for having the rights to sell it. Vendor libraries may carry their own license terms, shown at purchase. We may remove content from the store at any time, but removal does not revoke licenses you have already purchased except as provided in the applicable license.
06 · Intellectual property
Intellectual property
The Services and their content (excluding content you or vendors own) are the property of Koda and its licensors. You may not use the KODA name or logo without our permission. If you believe content on the Services infringes your rights, contact us at support@kodasampler.com with details.
07 · Liability
Disclaimers and liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, KODA DISCLAIMS ALL WARRANTIES REGARDING THE SERVICES, AND KODA'S TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID KODA IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE AND (B) FIFTY US DOLLARS (US$50). NOTHING IN THESE TERMS LIMITS RIGHTS YOU HAVE UNDER MANDATORY CONSUMER PROTECTION LAW.
08 · Termination
Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access to the Services for breach of these Terms. Licenses you have validly purchased survive per their own terms.
09 · Governing law
Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules, subject to any non-waivable consumer rights in your home jurisdiction.
10 · Changes
Changes
We may update these Terms; the current version will always be posted on this page with its date. Material changes will be notified to account holders where reasonably possible. Continued use after changes take effect constitutes acceptance.
